Terms and Conditions, Shipping Information and Returns policy
1) TERMS & CONDITIONS OF SALE
These Terms and Conditions of Sale (Terms & Conditions) apply to all sales of products and services (Products) by Namek Technologies, its subsidiaries and affiliates to you (the Customer).
PROOF OF PURCHASE: Your INVOICE is your proof of purchase from Namek Technologies.
ACCEPTANCE:
Customers will be deemed to have accepted these Terms & Conditions by placing an order with Namek Technologies. Namek Technologies’s acceptance of Customer’s order is considered Customer’s acceptance of these Terms & Conditions. These Terms and Conditions supersede any other agreement.
ORDER AND SHIPMENT:
Namek Technologies is not be bound by any terms and conditions set forth by customer unless previously agreed to by Namek Technologies in writing. Unless otherwise agreed in writing, delivery will be made in accordance with Namek Technologies’s shipping policy on the date of order. Insurance coverage, transportation costs and all other expenses applicable to shipment from Namek Technologies to the Customer’s identified delivery place will be the responsibility of the Customer. Namek Technologies will replace the lost or damaged Product or issue a credit memo at its sole discretion.
OTHER TERMS AND CONDITIONS:
1) Namek Technologies is not responsible for typographical errors.
2) Namek Technologies reserves the right to change the terms and conditions of sales at Namek Technologies at any time.
3) All sales at Namek Technologies are governed by Indian Laws at Pune Jurisdiction only.
4) No Namek Technologies employee or agent has the authority to vary any Namek Technologies policies or the terms and conditions governing any sale.
DISCLAIMER AND LIMITATION OF LIABILITY:
NAMEK TECHNOLOGIES IS NOT LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR THE INABILITY TO USE THE MATERIAL ON THIS SITE. THIS INCLUDES BUT IS NOT LIMITED TO THE LOSS OF DATA OR LOSS OF PROFIT, EVEN IF NAMEK TECHNOLOGIES WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
NAMEK TECHNOLOGIES (THE COMPANY) MAKES NO WARRANTIES OF ANY KIND WITH REGARD TO THE PRODUCTS IT DOES NOT MANUFACTURE. THE COMPANY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, AS TO THE PRODUCTS, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN NO EVENT WILL THE COMPANY BE LIABLE FOR ANY LOSS, DAMAGE OR COST OF OR BREACH OF WARRANTY. THE COMPANY WILL NOT, IN ANY EVENT, BE LIABLE FOR ANY LOSS OF REVENUE, PROFIT, USE OF DATA, INTERRUPTION OF BUSINESS OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL, EXEMPLARY OR PUNITIVE DAMAGES, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT, OR IN ANY WAY CONNECTED TO THIS AGREEMENT, EVEN IF THE COMPANY HAS BEEN ADVISED OF SUCH DAMAGES. THE FOREGOING LIMITATION OF LIABILITY WILL APPLY WHETHER ANY CLAIM IS BASED UPON PRICIPLES OF CONTRACT, WARRANTY, NEGLIGENCE OR OTHER TORT, BREACH OF ANY STATUTORY DUTY, PRINCIPLES OF INDEMNITY OR CONTRIBUTION, OR OTHERWISE. IN NO EVENT WILL NAMEK TECHNOLOGIES’ LIABILITY TO CUSTOMER EXCEED THE PURCHASE PRICE PAID FOR THE PRODUCT THAT IS THE BASIS OF THE CLAIM.
2) Shipping Information and Returns Policy
The most important thing to remember is that we will always try to do the “right thing.”
We value your business and we want to be your supplier of choice.
Shipping Information – We make use of the best courier services. Choice of courier is made depending on your area code.
We generally ship the items between 2-3 days from the date of order depending upon what product you have ordered. Before shipping the product, we need to assemble and test it to ensure you have a hassle free shopping experience.
After the product handed over to the courier, you will be able to see the tracking details on your account section. Tracking data is usually available within 24 hours.
Returns Policy –
To have a smooth transaction , we request you to read the description of the products carefully and contact us if you have ANY questions or doubts regarding the products.
Damaged Goods – If you receive a damaged product , Immediately refuse the package from the courier company. We insist the you always open the package and inspect the contents for any physical damages BEFORE signing on the courier manifest. If you sign the manifest, you accept that the goods are in perfect condition and we will not be able to recover the losses from the courier company. You must immediately contact us if you receive a package in damaged condition.
7 day Returns for any other reason – If you are not satisfied with the product for reasons other than damaged goods, you can return the product for a refund subjected to following terms :
– Return / cancellation request must be placed within 7 days of delivery via an email to sales [at] namektechnologies.com
– We must receive the product must be in mint condition with good packaging and original invoice. Please note that you are responsible for shipping costs.
– A 30% restocking fee will be applied on the original transaction amount. Taxes (GST) and shipping costs are not refundable.
– Digital Goods (Services,Support, Downloadable items) are not refundable once purchased.
